Terms & Conditions

1. PAYMENT TERMS

  • Payment is required in full according to the agreed schedule. By default, Payment in Advance (PIA) applies unless otherwise agreed in writing by both parties.
  • Payments must be made in the currency specified on the invoice unless otherwise agreed upon in writing.
  • Accepted payment methods include wire transfer, cheque, or cash. Any other payment method requires written confirmation from our accounts team.
  • All banking charges incurred during payment are the responsibility of the customer. If payment is received without necessary fees, the customer must pay these fees or reimburse Aeon Shipping or its subsidiaries.
  • In the event of shipment cancellation or rescheduling, the following fees apply:

Cancellation: operational costs + 15% of the invoice value

Rescheduling: operational costs + AED 1,000

  • All charges are payable in full without deductions, withholdings, set-offs, or credits due to counterclaims against Aeon Shipping or its subsidiaries. Access to the cargo may be restricted until all outstanding charges are paid.
  • If an invoice is disputed, the customer must notify Aeon Shipping in writing within 2 days of receipt. Failure to dispute within this period will be considered acceptance of the invoice, and payment will be due in full. Upon dispute, the final invoice will be issued by the accounts team, and this invoice will be deemed final.
  • If payment is not received by the due date, Aeon Shipping reserves the right to apply the following late payment charges and actions:

  • Day 14: Second abandonment notice.
  • Day 21: Final abandonment notice.

1.2) For Storages:

Billing Cycle:

  • Invoice Date: 25th of each month
  • Due Date: 1st of the following month
  • 3rd of each month: Late payment notice; cargo access restricted.
  • 14th: Storage termination notice; lock/keys may be changed at a fee of AED 500 or the actual cost, whichever is higher.

Important:

Upon final abandonment notice, Aeon Shipping reserves the right to move and/or sell stored items. Proceeds from the sale will first cover disposal costs, then outstanding balances, with any remaining funds held for the customer. If the sale does not cover costs, any unpaid balances will remain the customer’s responsibility.

2. AUTHORIZING THIRD PARTIES

By accepting this agreement, you authorize any person delivering or collecting cargo at our warehouse or elsewhere on your behalf to sign all relevant documents, including terms and conditions. Their signature will be legally binding as if it were your own.

3. INSURANCE

3.1 Marine Insurance:

Customers are advised to procure comprehensive insurance for goods in transit. Aeon Shipping offers insurance options through our partners, covering:

  • Household Goods: All-Risk cover at 2.0% of declared value, minimum premium AED 950.
  • Automobiles: All-Risk cover at 2.0% of declared value, minimum premium AED 950.
  • Total Loss Only: Coverage at 0.5% of declared value.

Note: Each item must be insured individually. Aeon Shipping assumes no liability for uninsured goods or goods not packed by Aeon Shipping.

3.2 Warehouse Insurance:

Our storage facility includes AED 50,000 per vehicle coverage for theft, fire, and loss (indoor storage only). A deductible of AED 2,000 applies, borne by the vehicle owner. Additional insurance is available upon request. Aeon Shipping is not liable for damages due to mechanical failure, and liability for any loss or damage is limited as stipulated.

3.3 Claims:

All claims for loss or damage must be reported at delivery, with written notice within 3 days. If requested in writing, this period may extend to 7 days. Failure to comply will result in waiver of claims.

4. SHIPMENTS - GENERAL TERMS AND CONDITIONS

4.1 Quotation and Validity:

(a) The quotation provided by Aeon Shipping is subject to validity, and upon expiration, the quoted price may change accordingly.
(b) The current carrier tariff and applicable surcharges are included in the quoted price.
(c) Any variation in the Freight (sea/air) charges or surcharges at the time of shipment execution will result in proportional adjustment to the quoted price.
(d) Aeon Shipping reserves the right to revise the quoted price or impose additional charges if any of the following circumstances occur:

(i) Failure to provide written confirmation or signature of the job agreement, including a firm removal date agreed upon by both parties.
(ii) Changes in costs due to fluctuations in currency exchange rates, taxes, or freight charges by carriers or service vendors outside our control.
(iii) Services are requested on a Friday or public holiday.
(iv) Goods must be collected or delivered from above the ground or first upper floor.
(v) Insufficient or inadequate stairs, lifts, or doorways for free movement of goods, necessitating mechanical equipment or structural alterations.
(vi) Inaccessibility of the road or driveway for the vehicles and containers required to load/unload goods within 20 meters of the doorway.
(vii) Delays or events outside of Aeon Shipping’s reasonable control or reliance on third-party services.
(viii) Shipments exported under exit paper or trip ticket are subject to customs inspection, incurring an additional charge of USD 150.00 or more.
(ix) Aeon Shipping will not assume responsibility for any security deposits related to exit paper shipments.
(x) Unless specified in the quotation, the quoted price excludes any form of insurance, guarantees on the commodity, customs clearance, customs duties, inspections, or other government-related fees.

4.2 Work Not Included in Our Quotation:

Unless explicitly agreed upon in writing, Aeon Shipping will not be responsible for the following:


(a) Dismantling or assembling furniture.
(b) Disconnecting, reconnecting, dismantling, or reassembling appliances, fixtures, fittings, or equipment.
(c) Laying or removing foot coverings.
(d) Moving items from a loft unless safe access, proper lighting, and flooring are provided.
(e) Dismantling or assembling garden furniture, including sheds, greenhouses, outdoor play equipment, and similar items.
(f) Moving items such as paving slabs, planters, and other similar goods.
(g) Aeon Shipping staff are not authorized or qualified to perform the above-mentioned tasks. Customers are advised to hire properly qualified personnel for these services.

4.3 Customer Responsibilities:

It is the responsibility of the customer to:

(a) Ensure vehicles are clean at the time of handover/pickup, with no additional cleaning charges applied.
(b) Declare the value of goods being removed or stored.
(c) Arrange adequate insurance coverage for the goods being transported or stored, covering all insurable risks.
(d) Obtain all necessary documents, permissions, and approvals for the removal process at the customer’s expense.
(e) Be present or designate a representative to ensure the security of the goods during removal, transit, and delivery.
(f) Sign inventories, receipts, waybills, job sheets, or other relevant documents as confirmation of collection or delivery.
(g) Take reasonable precautions to ensure no goods are taken in error or left behind.
(h) Properly prepare and stabilize all appliances and electronic equipment for removal, including defrosting and cleaning refrigerators/freezers and draining washing machines.
(i) Provide a valid contact address for correspondence during transit and storage.
(j) Aeon Shipping will not be liable for any loss or damage, costs, or additional charges arising from failure to comply with the above responsibilities, except where caused by our negligence.

4.4 Goods Excluded from Removal or Storage:

The following items are specifically excluded from removal or storage under this contract:

(a) Jewelry, watches, trinkets, precious stones, metals, money, or any other valuable items.
(b) Dangerous, hazardous, explosive, or damaging items, including gas bottles, aerosols, paints, firearms, and ammunition.
(c) Plants or goods likely to cause vermin infestation.
(d) Refrigerated or frozen food or beverages.
(e) Any animals, including pets, birds, or fish, along with their cages or tanks.
(f) Goods requiring special licensing or government authorization for export or import.
(g) Goods restricted by the carrier or customs.
(h) If goods of these types are submitted without our knowledge or prior written consent, Aeon Shipping will not be liable for any loss or damage, and the customer agrees to indemnify us for any charges, expenses, or penalties incurred as a result. Aeon Shipping reserves the right to dispose of such goods without notice.

4.5 Ownership of Goods:

By entering into this contract, the customer warrants that:

(a) The goods being removed or stored are either owned by the customer or the customer has the authority from the owner(s) to enter into this contract on their behalf.
(b) The customer will indemnify Aeon Shipping against any claims, damages, or costs arising from a breach of this warranty.

4.6 Payment for Removal Services:

Unless otherwise agreed, payment for removal or storage services is required in advance, based on the quotation provided.

(a) Payments are due immediately upon shipment collection.
(b) Failure to settle the invoice will result in a storage fee of AED 60 per automobile per day and AED 1 per square foot per day for household goods, starting from the date of collection.
(c) The final invoice will be based on the actual weight/volume of the goods packed and transported.

4.7 Express Shipments:

(a) The final invoice for express shipments will be based on the chargeable weight (whichever is higher between actual or volumetric).
(b) If the actual weight of any package exceeds 60 kg, additional charges may apply.
(c) Remote area delivery may incur additional charges.
(d) Shipments may be opened and inspected by the carrier, and restricted items will be removed as necessary.
(e) Restrictions on air freight include food items, batteries, cosmetics, perfumes, liquid products, pressurized containers, jewelry, coins, and banknotes.
(f) Volume weight calculation for air freight (express): Length × Height × Width / 5000.

4.8 Transit Time, Waiting Time, and Delays:

(a) Aeon Shipping will not be liable for delays in transit caused by factors beyond our control. If delivery cannot be completed, goods will be taken into storage at the customer’s expense.
(b) Transit times are estimates and subject to change. Delivery dates are subject to customs clearance, and Aeon Shipping will not be responsible for claims arising from early or late arrivals.
(c) Consolidated/shared shipping may result in fluctuating waiting times based on load volume.

4.9 Storage Terms:

(a) Unless otherwise agreed, storage payments are due monthly in advance, with one month’s charges paid as a deposit.
(b) If storage payments are not made by the due date, Aeon Shipping reserves the right to dispose of the goods and recover outstanding payments.
(c) It is the customer’s responsibility to arrange insurance for goods stored with Aeon Shipping. If Aeon Shipping arranges insurance, a detailed inventory must be provided before storage begins.
(d) All services are subject to Aeon Shipping’s standard trading terms and conditions, which limit liability as an intermediary.

5. STORAGE - GENERAL TERMS AND CONDITIONS

5.1 Appointment and Term:

Aeon Shipping or its subsidiaries grant you the right to:

(a) Store your items in the allocated storage space as per this agreement.
(b) Access your items during the agreed Access Hours, subject to clause 5.2, including the ability to remove or return items.
This agreement will start on the Storage Start Date and continue until the Storage End Date, unless extended by mutual consent per clause 5.7.

5.2 Third Parties and Access:

Access to your items is allowed only by you, or by persons authorized by you in writing. Visitors must have valid identification. You are responsible for any actions or omissions by such persons. Aeon Shipping has the right to refuse access to the site if there are security or safety concerns. Changes to the access hours will be communicated in writing, though Aeon Shipping retains the right to modify these hours. If you wish to show your items to potential buyers, prior written authorization from Aeon Shipping is required.

5.3 Rights of the Storage Space Operator:

Aeon Shipping retains a lien on your items for any unpaid charges. If payment is not made by the due date, Aeon Shipping may sell, dispose of, or move your items at your expense. You will not be granted access to your items unless all charges are paid. In emergencies or if necessary to prevent damage or injury, Aeon Shipping may access your items without notice.

5.4 Obligations and Warranties:

  • 5.4.1 You must ensure the items and their contents belong to you, or you have authority to store them.
  • 5.4.2 The following items are prohibited:
    (a) Food or perishable goods unless securely packed to prevent vermin.
    (b) Animals or living creatures.
    (c) Gas containers, except with certain conditions.
    (d) Firearms, ammunition, explosives.
    (e) Hazardous materials, including chemicals, asbestos, or toxic substances.
    (f) Illegal items.
  • 5.4.3 You must provide a spare set of keys for any vehicle.
  • 5.4.4 You are responsible for ensuring all necessary documentation for your vehicle is provided.
  • 5.4.5 You must keep your contact details up to date.
  • 5.4.6 If your vehicle cannot start and requires towing or battery replacement, you are responsible for these costs.
  • 5.4.7 You must not:
    (a) Cause any nuisance or damage.
    (b) Violate insurance policies.
    (c) Use the storage for accommodation or office space.
    (d) Cause damage to other property.
  • 5.4.8 You must take reasonable care of your items and property, inform Aeon Shipping of any defects or damages, and comply with safety regulations.
  • 5.4.9 You must comply with health, safety, and security rules while your items are on the site.
  • 5.4.10 You agree to indemnify Aeon Shipping for any losses or damages resulting from your breach of these terms.

5.5 Non-exclusivity:

  • 5.5.1 This agreement does not grant you exclusive possession of the storage space. Aeon Shipping may require you to move your items to another space with 28 days’ notice.
  • 5.5.2 The agreement does not make Aeon Shipping a bailee of your items. You store your items at your own risk. If you fail to remove your items when required, you must arrange for their removal at your own cost.

5.6 Change of Items and Change of Ownership:

  • 5.6.1 When updating your storage agreement, you must provide the length of time your items will be stored, and acknowledge the storage fee based on this duration.
  • 5.6.2 If you need to store a different item, you must inform Aeon Shipping, who may adjust the storage charges accordingly.
  • 5.6.3 An “upgrade fee” may apply based on the size of the new items.
  • 5.6.4 You must pay the upgrade fee promptly.
  • 5.6.5 If your items change, Aeon Shipping may alter the storage space and charge accordingly.
  • 5.6.6 You will be required to pay any upgrade charges even if the storage space is not changed.
  • 5.6.7 If you sell or transfer ownership of your items, the terms of this agreement remain in effect. The new owner must sign a new customer form.

5.7 Renewal and Termination:

  • 5.7.1 A payment is required to store items. For renewals, new terms must be agreed, and payment in full will trigger an invoice.
  • 5.7.2 If you do not remove your items by the agreed date or fail to make payment, you will be deemed to have accepted the agreement, and Aeon Shipping may exercise its lien rights.
  • 5.7.3 If you breach the agreement, Aeon Shipping may terminate it with 14 days’ notice.
  • 5.7.4 If you fail to collect your items by the deadline, Aeon Shipping may move them at your cost. If necessary, items may be sold to cover fees.
  • 5.7.5 If your items cannot be sold or economically disposed of, you authorize Aeon Shipping to treat them as abandoned and dispose of or destroy them.

5.8 General:

  • 5.8.1 Provisions of this agreement can be severed if necessary.
  • 5.8.2 Any amendments must be in writing and signed.
  • 5.8.3 This agreement is personal to you and cannot be assigned unless specified. If there are multiple parties, they are jointly liable for the obligations.
  • 5.8.4 Notices under the agreement can be sent by email, in person, or by registered post.
  • 5.8.5 This is the entire agreement between the parties, superseding all prior agreements.
  • 5.8.6 The agreement is governed by UAE law, and any disputes will be subject to the exclusive jurisdiction of UAE courts.
